Terms of Service

1. Acceptance of Terms

By accessing or using Scrum Poker ("the Service"), operated by Othecos ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Scrum Poker is a real-time planning poker application for agile teams. The Service allows users to create rooms, invite participants, and conduct estimation sessions collaboratively.

3. Accounts

  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • You must provide accurate and complete information when creating an account.
  • You agree to notify us immediately of any unauthorized use of your account.

4. Free and Paid Plans

The Service offers a Free tier with limited features and a paid Pro plan with additional capabilities.

  • Paid subscriptions are billed monthly or annually through Stripe.
  • By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel.
  • Prices are listed in USD and may be updated with 30 days' prior notice.
  • Subscription fees are non-refundable except as required by applicable law.

5. Cancellation

You may cancel your subscription at any time through your billing settings or the Stripe customer portal. Upon cancellation:

  • Your Pro features remain active until the end of the current billing period.
  • After that, your account reverts to the Free plan.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or to violate any applicable laws or regulations.
  • Attempt to gain unauthorized access to the Service, other accounts, or any related systems.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Transmit any malicious code, viruses, or harmful content through the Service.
  • Use automated means to access the Service without our prior written consent.

7. Intellectual Property

  • The Service, including its design, code, and content, is owned by Othecos and protected by intellectual property laws.
  • You retain ownership of any data you input into the Service.
  • We do not claim ownership over your estimation data or room content.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind, whether express or implied. To the maximum extent permitted by law, Othecos shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via the email associated with your account at least 30 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance.

10. Termination

We may suspend or terminate your access to the Service at our discretion if you violate these Terms. Upon termination:

  • Your right to use the Service ceases immediately.
  • Provisions that by their nature should survive (including liability limitations and dispute resolution) will remain in effect.

11. Governing Law

These Terms are governed by the laws of Brazil. Any disputes arising from these Terms or the Service shall be resolved in the courts of Brazil.
